internet was banned in Rohtak amid the violence of the Jat quota stir In last year’s India report for the Freedom on the Net study we triumphantly closed the study noting there were almost no internet shutdowns in India Since then things have escalated Internet services were suspended six times in Gujarat in August-October 2015 when there was also one shutdown in Rajasthan and one in Manipur Suspension of services in Kashmir takes place with regularity and impunity and is barely noticed Given that suspension of internet services is quickly moving towards becoming commonplace someone finally took the issue to the SC for some reining in of government powers The remedy sought by lawyer Apar Gupta on behalf of law student Gaurav Vyas was simple The government currently uses different laws to suspend access to communication The petition before the SC asked that the government be compelled to confine itself to a single mechanism outlined in the Indian Telegraph Act and the Information Technology Act (IT Act) for suspension of communication The idea was that since sector- and subject-specific mechanisms exist within these legislation the government should be encouraged to use these instead of resorting to wide and general legal mechanisms that may not be designed or equipped to deal with suspension of communication It was also argued that the government should develop guidelines for when and how internet services may be suspended The legal mechanism usually used to shut down internet services is the procedure contained in Section 144 of the Criminal Procedure Code (CrPC) which requires a written order from a magistrate This broadly-worded section permits the government to issue an order to “prevent… obstruction annoyance or injury to any person lawfully employed or danger to human life health or safety or a disturbance of the public tranquillity or a riot of an affray” It’s a pre-Independence legal provision of some notoriety It has been deployed more than once to prevent protests by citizens notably even during the protests that followed the rape and death of Jyoti Singh in Delhi Section 144 has survived constitutional challenges and been held consistent with the right to freedom of expression as contained in Article 19(1)(a) of the Constitution The constitutional challenge to Section 144 took place well before the internet and couldn’t have anticipated the effect this power would have on communication in digital society The new trend of leveraging this power to prevent online communication is disturbing The effect of a Section 144 order is enormous if it shuts down communication across the state — it’s not clear how a magistrate will assess whether a state-wide shutdown is warranted or how much damage such a shut-down might do As the Digital India programme is rolled out our reliance on internet-based communication for essential services will increase making it even more problematic every time a state decides to suspend mobile internet services The SC is yet to give the matter substantive consideration since it refused to admit the petition However the Gujarat High Court ruled on a closely related argument last year when Vyas asked that any suspension of internet must take place through the IT Act and not using Section 144 Here the high court failed to see the need for safeguards limiting the exercise of this power This ambiguity surrounding how Section 144 may be used for internet shutdowns led to the petitioners asking the SC for guidelines that might indicate the threshold and limits of such power The argument before the SC seems to have added to the arguments before the high court — it also included Section 5(2) of the Telegraph Act in addition to Section 69A of the IT Act as avenues the government might use for internet suspension Section 5(2) gives the government power to order suspension or interception of messages transmitted from telegraph It simplifies matters too much to cast the situation as a binary conflict between individual rights and law and order concerns Uninhibited state power to suspend internet services threatens not just individual rights but democracy itself It’s characteristic of states like Sudan Kazakhstan and China Rules detailing and limiting when internet services may be suspended would balance both concerns and provide courts with developments will have a bearing on next year’s assembly election and will certainly spill over into the battleground of Uttar Pradesh Gujarat hasn’t seen even a minor agitation in the past two decades on the caste front There was a rare farmers’ agitation around environment concerns which stopped the Nirma project in Saurashtra But with the outbursts of Dalits (75 per cent of the state’s population) and Patels (around 15 per cent) receiving a clandestine push from the Congress anti-BJP political forces and disgruntled BJP leaders Gujarati society is volatile once again Gujarat without Modi has entered a new time zone After the agitation led by Hardik Patel the Patel community boycotted BJP’s Patel leaders Ministers like Nitin Patel and Saurabh Patel were not allowed to hold public rallies they were barred from many Patel-dominated areas and humiliated publicly Junior home minister Rajni Patel’s residence in Mehsana was burnt down twice by members of the Patidar community Even should not be taken lightly because Gujarat has been a trendsetter in national politics The anti-Mandal agitation of 1990 had a precursor in the Anamat Andolan of 1985 in Gujarat Jayaprakash Narayan was inspired by Gujarat’s Nav Nirman Andolan Started in 1973 by students of an engineering college to protest against high prices of their hostel food it forced then Chief Minister Chimanbhai Patel to resign in February 1974 The current anger in Gujarat over self-finance colleges (part of the Gujarat model) that charge around Rs 30000 a year as fees for arts and commerce courses is no different Some of the colleges started in the past 20 years are largely owned or supported by the BJP MLAs MPs or by members of their families Not surprisingly the party’s political machinery does not take up the issue of unaffordable education The youth’s support to Hardik Patel has a lot to do with Gujarat’s dismal education system It is apparent that the glue of hardened Hindutva has started coming off within two years of Narendra Modi’s exit as chief minister There was a time when Modi was applauded for talking about “Miyan Musharraf” but today Gujaratis are heard talking about “ISI men being courted by India in Pathankot” Modi’s presence in Gandhinagar was once so heavy that even the state Congress president would not talk to journalists without checking to ensure that “nobody is listening” At a paan stall in Baroda or at the bus stand in Rajkot it was impossible to question Modi’s decisions But on July 23 Dalits came out in big numbers shouting slogans against Modi at his hometown Vadnagar Modi being jeered at a public rally and that not being countered is a sign of change If the five-lakh strong mahakranti rally of Patels on August 24 last year was a wake-up call for the Gujarat BJP in the post-Modi era the current Dalit assertion is the people’s way of demanding action from the jaded party in Gujarat That the situation is far from normal is clear by the silence of PM Modi and BJP president Amit Shah It seems they want to let the CM face the music alone and keep the issue Gujarat-centric The CM knows that the Patel agitation was primarily against the idea of reservation itself and the Dalits anger is against inadequacies of the reservation system where the advantages of more than six-decades of affirmative actions have not reached the lower rungs of the lowest section of the caste pyramid The CM also faces the frustration of the youth due to unaffordable education and diminishing employment prospects If the Gujarati farmers are not on the streets yet it’s only because they are hoping against hope that the rainfall deficit of around 49% will reduce by the end of the season CM Patel 74 an efficient administrator and weak political communicator is perceived by the cadre as one whose exit is just a matter of time They believe that even if under her leadership the BJP goes to the polls she won’t be CM if the party wins She has tried to correct the perception lately saying if the party wants she will continue as CM after winning the next election But her problems are not merely about handling antagonists in the cabinet or the vertically-divided party (Amit Shah camp versus Anandiben camp) but the Gujarati bazaars The micro small and medium enterprises (MSMEs) in kapada (textiles) bazaar in Ahmedabad heera bazar (diamond market) in Surat and engineering markets in Rajkot and Baroda have either plateaued or face various types of uncertainties including issues with the tax departments Reports of business associations have claimed that Chinese competition (engineering goods) and lack of finance and smart marketing have failed middle-class entrepreneurs in past two-three years After Modi’s exit from Gandhinagar around 29 lakh MSMEs have faced dramatic downturn The RBI data says the outstanding loans of MSMEs has increased from Rs 836 crore in 2012-13 to Rs 2601 crore in 2014-15 and the number of sick units became Jharkhand’s first non-Adivasi chief minister Das is the 10th chief minister in a state that is only 14 years old It would be an understatement to say that the political history of this fledgling state has been turbulent Jharkhand’s recent past has been marked by spectacular corruption administrative incompetence and a splintered Maoist insurgency A decisive majority for the BJP-AJSU coalition in the Jharkhand assembly following the BJP’s victory in 12 of the 14 Lok Sabha constituencies in the state is thus a critical moment in the state’s history Activists speaking on behalf of Adivasis have objected to Das’s appointment as chief minister because he is not an Adivasi himself Party sources however point to the humiliating loss of the three-time chief minister Arjun Munda in his constituency Kharsawan which made it difficult to elect him as leader of the new government The Narendra Modi-led BJP is also keen to develop new leaderships in the states as we have seen in Maharashtra already and Das is believed to be on good terms with both Modi and Amit Shah With Adivasi organisations protesting on the streets of Ranchi the voting public is now being assured that the deputy chief minister will be an Adivasi legislator There is undoubtedly more at stake here than the chief ministership The controversy over Das’s election goes to the heart of a deeper contradiction While the demand for Jharkhand emerged from Adivasi movements in the early-20th century the creation of the state in 2000 owes much to the BJP-led Centre at the time Of course there is no straight line connecting the mobilisations led by Jaipal Singh Munda the great Adivasi leader from the region in the 1940s and the political machinations of the 1990s that ended with the BJP delivering on its electoral promise to create smaller states out of Uttar Pradesh Madhya Pradesh and Bihar By the time Jharkhand was created the demands of leaders like Ram Dayal Munda a vocal campaigner for an Adivasi state over the previous two decades had been overshadowed by the BJP’s growing electoral interests in regions where they had a poor track record The Jharkhand that emerged in 2000 was far from being an Adivasi state The contours of the new state excluded the Adivasi-majority districts of Chhattisgarh Odisha and West Bengal which had been part of the demand for Jharkhand even during the states’ reorganisation in the mid-1950s As a consequence according to the 2001 Census only 263 per cent of the new state are recorded as ST The 2011 Census shows that little has changed in the state’s demographics: Adivasis are now 262 per cent of the state’s population Insofar as demographics play a part in the creation of electoral constituencies it ought to surprise no one that just 28 of the 81 Vidhan Sabha seats are reserved for ST candidates while 44 are unreserved constituencies The relationship between Adivasis and the BJP today is based on future expectations If Adivasis have voted decisively for the BJP not once but twice this year we need to understand why The success of the BJP government in neighbouring Chhattisgarh has played a significant role in the political calculations of ordinary Adivasis Chhattisgarh boasts of a well-functioning public distribution system for instance which Jharkhand’s poor can scarcely find believable In contrast the JMM has offered little except fiery words over the past decade The other parties are not large enough to lead a stable government in the state Counter-insurgency has pushed the Maoists to the brink The presence of the Chhattisgarh chief minister at Das’s swearing-in ceremony was no accident The BJP understands what Adivasi voters expect from it in Jharkhand The BJP also understands what the non-Adivasi majority in Jharkhand
